Do All Estates Have to Go Through Probate in Georgia?

Not always. That said, if a person owned property solely in their name or did not have a complete estate plan, probate will likely be required.

Probate With or Without a Will in Georgia

If your loved one had a will, the probate process follows the instructions in that document. If there was no will – what Georgia law calls dying "intestate" – the estate is distributed according to Georgia's intestacy laws under O.C.G.A. § 53-2-1.
