Losing someone you love is one of the hardest things a person can go through. Unfortunately, the legal process does not pause for grief. Probate – the court-supervised process of settling a deceased person's estate – can feel overwhelming when you are already dealing with so much.

Probate in Georgia is handled through the Probate Court in the county where the deceased person lived. For Atlanta-area families, that typically means Fulton County, DeKalb County, Cobb County, or Gwinnett County – all courts our team is familiar with. We also serve families throughout the northern Atlanta suburbs, including Alpharetta, Roswell, Marietta, Sandy Springs, and Johns Creek.
What the Probate Process Involves
- Filing the will with the appropriate Georgia Probate Court
- Petitioning to open the estate and appoint a personal representative (executor or administrator)
- Notifying creditors and beneficiaries as required by Georgia law
- Inventorying and valuing the estate's assets

Do All Estates Have to Go Through Probate in Georgia?
Not always. Certain assets pass directly to beneficiaries without going through probate – things like life insurance policies with a named beneficiary, jointly held property with right of survivorship, and assets held in a trust. That said, if a person owned property solely in their name or did not have a complete estate plan, probate will likely be required.
This is one of the reasons estate planning matters so much. The right plan can help your family avoid probate entirely – or at least make the process much simpler.
Probate With or Without a Will in Georgia
If your loved one had a will, the probate process follows the instructions in that document. If there was no will – what Georgia law calls dying "intestate" – the estate is distributed according to Georgia's intestacy laws under O.C.G.A. § 53-2-1. In either case, our team can guide you through the process and make sure things are handled correctly.
